Murray Supervisor of Records October 27, 2020 SPR20/1967 Lieutenant Kevin Ware Town of Braintree Police Department 282 Union Street Braintree, MA 02184 Dear Lieutenant Ware: I have received the petition of Marguerite Edwards appealing the response of the Town of Braintree Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Edwards requested all incident reports stemming from Ms. Edwards’ call for assistance from the Department pertaining to lost property at her residence, and a call to the Department pertaining to a neighbor dispute. The Department provided Ms. Edwards with all the incident reports from May 6, 2020; May 24, 2020 and September 30, 2020 in an un-redacted format. A review of the records provided to this office by Ms. Edwards reveals that the incident reports were provided to her. It appears that Ms. Edwards is unsatisfied with the content of the reports, stating, “This info is bogus and of no value to me.” As a result of Ms. Edwards’ petition, this appeal was opened. In an October 27, 2020 conversation with a Senior Attorney in the Public Records Division, you explained that Ms. Edwards was provided with all the incident reports more than once, and that the Department has no further records responsive to Ms. Edwards’ request. There is no obligation to create a record in response to a public records request. See G. L. c. 4, § 7(26); see also 32 Op. Att’y Gen. 157, 165 (May 18, 1977). Accordingly, whereas the Department has provided Ms. Edwards with all the responsive records, I will consider this administrative appeal closed.
