The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records October 29, 2020 SPR20/1978 Thomas Mayo Town Administrator Town of Hingham 210 Central Street Hingham, MA 02043 Dear Thomas Mayo: I have received the petition of Daniel Nardo appealing the response of the Town of Hingham (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on July 27, 2020, Mr. Nardo requested five categories of records related to a certain police incident. Previous appeal The requested records were the subject of a previous appeal. See SPR20/1338 Determination of the Supervisor of Records (August 20, 2020); SPR20/1696 Determination of the Supervisor of Records (September 29, 2020). In my September 29th determination, I found the Town had not met its burden of explaining with specificity how the records, in their entirety, are exempt from disclosure under Exemptions (f), (c), (o), or (p). I ordered the Town to provide Mr. Nardo with a response to the request, provided in a manner consistent with the order, the Public Records Law and its Regulations. The Town provided said response on September 29, 2020. Unsatisfied with the Town’s response, Mr. Nardo petitioned this office and this appeal, SPR20/1978, was opened as a result. Conclusion Subsequent to the opening of this appeal, on October 26, 2020, the Town emailed this office and indicated they provided a response to Mr. Nardo which included responsive records. Thomas Mayo SPR20/1978 Page 2 October 29, 2020 In light of this response, I consider this administrative appeal closed. Mr. Nardo may appeal the substantive nature of the Town’s response within 90 days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Daniel Nardo
