G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Higgins submitted a request for records within the possession of the Town relating to restaurant health inspection reports. Claiming to not yet have received a response, Mr. Higgins petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Town intends on providing a written response to Mr. Higgins. Accordingly, the Town is ordered to provide Mr. Higgins with a response made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of each response to this to this office at pre@sec.state.ma.us. Mr. Higgins may appeal the substantive nature of the Town’s response within ninety days.
