Murray Supervisor of Records October 28, 2020 SPR20/2026 Greg Lucey City Clerk City of Malden 110 Pleasant Street, First Floor Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Brian DeLacey appealing the nonresponse of the City of Malden Office of the City Clerk (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on September 30, 2020, Mr. DeLacey requested “all available records, including reports, consultant bills and invoices, email, correspondence, spreadsheets and the like, related to any soil testing related to Roosevelt Park going back to 2010.” Claiming to not yet have received responsive records, Mr. DeLacey petitioned this office and this appeal, SPR20/2026, was opened as a result. Despite being notified of the opening of this appeal by a staff member of the Public Records Division, the City has yet to provide a response with respect to Mr. DeLacey’s September 30, 2020 request. Accordingly, the City is ordered to provide Mr. DeLacey with said response within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DeLacey may appeal the substantive nature of the City’s response within ninety (90) days.
