The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records November 10, 2020 SPR20/2094 Seah Levy Public Records Access Officer Law Department Cambridge City Hall 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of Peter Hahn appealing the response of the City of Cambridge (City) to a request for records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 20, 2020, Mr. Hahn requested 16 categories of records pertaining to King Open School, including several categories of records relating to the principal. On May 25, 2020, Mr. Hahn emailed the Department to clarify and supplement one category of his request. Previous determinations This request was the subject of previous determinations. See SPR20/0891 Determination of the Supervisor of Records (June 11, 2020); SPR20/1345 Determination of the Supervisor of Records (August 25, 2020). In my August 25th determination, I found the City must provide additional information to explain the basis of its fee estimate. On October 9, 2020, the City provided a supplemental response to Mr. Hahn. Unsatisfied with the City’s response, Mr. Hahn petitioned this office, and SPR20/2094 was opened as a result. Current Appeal In his appeal, Mr. Hahn states “…we appeal Cambridge's response dated October 9 as an insufficient response to your office's August determination letter and as long overdue from that determination as issued on August 25.” One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Seah Levy SPR20/2094 Page 2 November 10, 2020 After a review of the City’s October 9th response, it is unclear what the basis of Mr. Hahn’s appeal is. Specifically, it is uncertain what portions of the City’s response Mr. Hahn is appealing. Mr. Hahn is reminded that all petitions for appeal “shall specifically describe the nature of the requestor’s objections to the response or failure to timely respond.” 950 C.M.R. 32.08(l)(f). Conclusion Accordingly, Mr. Hahn must describe his specific objections to the City’s October 9th response. Sincerely, Rebecca S. Murray Supervisor of Records cc: Peter Hahn
