Cimino Clerk of the Council Town of Braintree One JFK Memorial Drive Braintree, MA 02184 Dear Ms. Cimino: I have received the petition of Lawrence Mackin appealing the response of the Town of Braintree (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 15, 2020, Mr. Mackin requested, “…all email correspondence between [a named] Town [Councillor] … and [named] town auditors …. Starting with January 1, 2020 and continuing through October 15, 2020 …includ[ing] all email attachments. Particular areas … are August and September of 2020.” Having received no response, Mr. Mackin appealed and SPR20/2127 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a response to Mr. Mackin to address his concerns. Accordingly, the Town is ordered to provide Mr. Mackin with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mackin may appeal the substantive nature of the Town's response within ninety days.
