Murray Supervisor of Records November 17, 2020 SPR20/2131 Stephen Kergo Executive Director Everett Housing Authority 393 Ferry Street Everett, MA 02149 Dear Mr. Kergo: I have received the petition of Steven Fitzgerald appealing the response of the Everett Housing Authority (Authority) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Fitzgerald requested the: “Certificates of Receipt of Open Meeting Law material regarding Chairman Domenic Puleo, Robert Norton, Legal Counsel Francis J. LaRovere III, Executive Director Stephen Kergo, Administrative Assistant Nicole DiPierro, Assistant Director Roberta Correale, Philip Colameta and John Barrett, pursuant to G. L. c. 30A, § 20(h) and 940 C.M.R. 20.04.” On November 2, 2020, the Authority provided Mr. Fitzgerald with requested records. Believing he was not provided with all of the records, Mr. Fitzgerald petitioned the Supervisor of Records, and this appeal was opened. In a November 17, 2020 telephone conversation with a Senior Attorney in the Public Records Division, you confirmed that the Authority has no further records responsive to the request. Given that these records relate to the Open Meeting Law and interpretation of the Open Meeting Law and its requirements fall within the authority of the Office of the Attorney General (AGO) and not this office, the parties may wish to contact the AGO about this matter. See G. L. c. 30A, § 23. Accordingly, I consider this administrative appeal closed.
