Murray Supervisor of Records November 17, 2020 SPR20/2205 Claudia Buruca Suffolk County District Attorney’s Office 1 Bulfinch Place Boston, MA 02114 Dear Ms. Buruca: I have received the petition of Evan Allen appealing the nonresponse of the Suffolk County District Attorney’s Office (Office) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on October 9, 2020, Mr. Allen requested the following records: “-…all the non-prosecution agreements the Suffolk DA's office has signed with people from 2010 - 2020. . .” Claiming to not yet have received a response, Mr. Allen petitioned this office and this appeal, SPR20/2108, was opened as a result. Under the Public Records Law and its Access Regulations (Regulations) all requests for public records must be met with a response within 10 business days of receipt of the request. G. L. c. 66, § l0(a)-(b). The response may contain, among other things, an offer to provide records, a fee estimate for provision of the records, or a denial. G. L. c. 66, § l0(b). All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Conclusion Despite being notified of the opening of this appeal and a communication from a member of the Public Records Division staff, no response has been provided. Accordingly, the Office is ordered to provide Mr. Allen with a response to the request, provided in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days.
