Assistant City Solicitor Law Department City of Brockton 45 School Street Brockton, MA 02301 Dear Attorney Bartlett: I have received the petition of Jeanne Holmes-Kireilis appealing the response of the City of Brockton (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 20, 2020, Ms. Holmes-Kireilis requested “[a]n opportunity to inspect and/or obtain a copy of any and all records, including but not limited to, communications, either electronic or hard copy, documents, papers, agendas, minutes, plans, etc., pertaining to 223 to 261 Thatcher Street on and between… January 1, 2015 and the present, as well as Horsley Witten Group, its representatives and assigns, and POUA, its representatives and assigns, and Sisters, their representatives and assigns, regarding 223 to 261 Thatcher Street and the city of Brockton, including all of its representatives. etc.” The City provided a response on November 25, 2020, which included responsive records, as well as a fee estimate for a portion of the records requested. Unsatisfied with the City’s response, Ms. Holmes-Kireilis petitioned this office, and SPR20/2332 was opened as a result. Subsequent to the opening of this appeal, the City provided additional responsive records to Ms. Holmes-Kireilis on November 30, 2020. The City also provided an additional response on December 8, 2020. Please be advised, the parties are encouraged to communicate to facilitate providing records more efficiently and affordably.
