Murray Supervisor of Records December 9, 2020 SPR20/2371 Helene Bettencourt Records Access Officer Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Mr. Gary Floyd appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on November 13, 2020, Mr. Floyd requested “any or all of the letters sent to parents o[r] guardians of the students in Connolly about the lack of English and Math that they received while they were incarcerated at the Judge Connelly Center during the 2017-2018 school year.” Claiming to not yet have received a response, Mr. Floyd petitioned this office and this appeal was opened as a result. I learned that the Department provided Mr. Floyd with a response to his request dated December 8, 2020. Whereas the basis of this appeal was opened as a result of the Department’s lack of response to Mr. Floyd’s request, I will now consider this administrative appeal closed. Mr. Floyd may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
