G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on December 6, 2020, Mr. Saklad emailed his request to cosmetologyandbarberingboard@mass.gov requesting: “…the most up to date [l]istings for all Barbers in Zip Code 02139.” In a December 7, 2020 email response, the Division informed Mr. Saklad, “[y]ou can request a list of all licensees on the website here: https://www.mass.gov/service-details/dpl- licensee-database-request.” After Mr. Saklad attempted unsuccessfully to obtain the responsive listings of all barbers in a specific zip code, he petitioned the Supervisor of Records (Supervisor), and this appeal was opened. In his petition to the Supervisor, Mr. Saklad stated, “[l]istings of all Barbers in Zip [C]ode 02139 isn’t available. Yet listings of all Barbers in Zip Code 02139 are in use at their Offices, and [l]istings of all Barbers in Zip Code 02139 are in use by Staff in their Offices.” It is unclear whether the Division is in possession of “a listing of all Barbers in Zip Code 02139.” The Division must clarify this. Conclusion Accordingly, the Division is ordered to provide Mr. Saklad with a response to the request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
