Stone Public Records Coordinator City of Springfield 36 Court Street, Room 123 Springfield, MA 01103 Dear Ms. Stone: I have received the petition of Gabriella Michaliszyn appealing the nonresponse of the City of Springfield (City) to a request for public records. See G. L. c. 66, § 10A; See also 950 C.M.R. 32.08(1). Specifically, on November 5, 2020, Ms. Michaliszyn requested the following records within the possession of the City: The participating voter list, in a CSV format, for the recent November 3, 2020 general election; The election results; the total number of ballots cast in the recent November 3, 2020 election broken down by each candidate, including write-in and blank votes. Claiming to not yet have received responsive records, Ms. Michaliszyn petitioned this office and this appeal, SPR20/2495, was opened as a result. Despite being notified of the opening of this appeal, the City has yet to provide a response with respect to Ms. Michaliszyn’s November 5th request. Accordingly, the City is ordered to provide Ms. Michaliszyn with a response consistent with the Public Records Law and its access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Michaliszyn may appeal the substantive nature of the City’s response within ninety (90) days.
