Staff Legal Counsel Office of Chief Legal Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Serra: I have received your petition on behalf of the Massachusetts Department of State Police (Department) requesting permission to charge for time spent segregating or redacting responsive records under G. L. 66, § 10(d)(iv). As required by law, the Department furnished a copy of this petition to the requestor. G. L. c. 66, § 10(d)(iv). Specifically, Attorney Joseph Hennessey requested 8 categories of records and statistics related to racial profiling in police stops, findings of dishonesty regarding State Police troopers, and troopers named on Brady/Giglio lists. Subsequent to the receipt of this petition, you informed this office that Attorney Hennessey had narrowed his request to “only the race statistics from the Millbury, Charlton, and Stubridge Barracks.” In light of this modified request, you requested that this office not act upon your fee petition of December 15, 2020.
