Director of Public Records City of Boston One City Hall Plaza One City Hall Square Boston, MA 02201 Dear Attorney Williams: I have received the petition of Attorney David Nathanson of Wood & Nathanson, LLP appealing the response of the City of Boston Police Department (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on December 3, 2020, Attorney Nathanson requested: • “…all documents regarding ballistics in this incident, including but not limited to photos, notes, worksheets, and reports. There were two [named] victims … I represent [named individual] … who was convicted of murder in this case. CORI restrictions do not prevent release of information to him. A CORI release is attached.” Unsatisfied with the response, Attorney Nathanson appealed and SPR20/2535 was opened as result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Attorney Nathanson. Accordingly, the City is ordered to provide Attorney Nathanson with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Nathanson may appeal the substantive nature of the City's response within ninety days.
