Hatch: On December 23, 2020 this office received your petition on behalf of the Georgetown Police Department (Department) requesting permission to charge for time spent segregating or redacting responsive records and a waiver of statutory limits on fees that may be assessed in responding to the request. G. L. c. 66, § 10 (d)(iv); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, the Department furnished a copy of their petition to the requestor, Stephanie Reitman. G. L. c. 66, § 10(c). On December 15, 2020, Ms. Reitman requested “all records of traffic stops, citations, and warnings for the week of 11/19/2017 through 11/25/2017 including copies of each, timestamped notations of radio transmissions indicating each stop’s beginning and end, and any reports that were prepared as a result of those stops (such as an arrest/incident report).” In an email to the requestor dated December 25, 2020, the Department states the request has been “narrowed to 11/24/2017 and 11/25/2017…Although it took a few hours to process, by narrowing the search we were able to complete the task without additional hours added and therefore will not be submitting any fee request.” Conclusion In light of the Department’s December 25th email, it is unnecessary to opine on the Department’s petition to charge for time spent segregating or redacting responsive records and request for a waiver of statutory limits on fees for responding to the public records request.
