Avitabile, Esq. of Rawson Merrigan & Litner, LLP appealing the response of the Peabody Police Department (Department) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). Specifically, on December 21, 2020, Attorney Merrigan of Rawson Merrigan & Litner, LLP requested the following records: “… all motor vehicle accident reports from December 1, 2020 through today, December 21, 2020 that are in your department’s possession, custody and control.” Unsatisfied with the Department’s response, Attorney Avitabile petitioned this office and as a result SPR20/2578. I learned that Department responded to Attorney Merrigan’s request with a response sent on December 23, 2020. Whereas the basis of this appeal was opened as a result of the Department’s December 21st response, I will now consider this administrative appeal closed. Sincerely, Rebecca S.
