Massachusetts Department of Transportation 10 Park Plaza, Suite 3510 Boston, MA 02116 Dear Attorney Doyle: I have received the petition of Harry Mattison appealing the nonresponse of the Department of Transportation (MassDOT) to his requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Mattison requested all emails containing certain keywords. Claiming to not yet have received a response, Mr. Mattison petitioned this office and this appeal was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether MassDOT has provided a response. As such, MassDOT is ordered to provide Mr. Mattison with a written response. Said response must be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mattison may appeal the substantive nature of MassDOT’s response within ninety days.
