Murray Supervisor of Records January 12, 2021 SPR20/2604 Kelly Cote Town Clerk Town of Uxbridge 21 South Main Street Uxbridge, MA 01569 Dear Ms. Cote: I have received the petition of Michael J. Shivick, Esq. appealing the response of the Town of Uxbridge (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 16, 2020, Attorney Shivick requested, “[a]ll records pertaining to the employment and/or contractual relationship of [named person], in relation to the Town, including but not limited to: any application(s), resume(s), negotiation(s), contract(s), performance review(s), disciplinary proceeding(s), legal action(s), notice(s) of separation and/or termination, or other documents and records of any kind which pertain to [named person] relationship with the Town, in any way, including any drafts of and notes pertaining to any such document(s) aforereferenced.” Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Attorney Shivick. Accordingly, the Town is ordered to provide Attorney Shivick with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Shivick may appeal the substantive nature of the Town's response within ninety days.
