Murray Supervisor of Records January 14, 2021 SPR20/2613 Joshua Levit Massachusetts Teachers Association 2 Heritage Drive, 8th Floor Quincy, MA 02171 Dear Mr. Levit: I have received the petition of Dr. Jennifer Curtis-Whipple appealing the nonresponse of the Massachusetts Teachers Association (Association) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 4, 2020, Dr. Curtis-Whipple requested “all documents and records, including emails, text messages and any communications from you, all WEA board members, MTA representatives, WEA membership, and non-union WPS employees” relating to a specific matter. Please note, the Massachusetts Public Records Law applies only to records created or received by a local or state government entity. Please be advised that records in the custody of Massachusetts Teachers Association are outside the jurisdiction of the Public Records Law as the Association is not a governmental entity. See 950 C.M.R. 32.02. Accordingly, whereas this office has no jurisdiction over records of the Association, I am unable to assist Dr. Curtis-Whipple any further in this matter. Sincerely, Rebecca S.
