Deputy General Counsel Office of the State Auditor One Ashburton Place Room 1819 Boston, MA 02108 Dear Attorney Ruane: I have received the petition of Jeffrey Fournier appealing the response of the Office of the State Auditor (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 18, 2020, Mr. Fournier requested the following records: “Any audit work papers associated with the December 7, 2017 audit of the Department of Children and Families that consist of T-SQL or PL/SQL code used to perform any data analysis completed in conjunction with, or in preparation for, that audit. Please remove/redact all references to networks, infrastructure, systems, servers, databases or that would allow any individual to present a cyber-security threat to the agency.” Unsatisfied with the Office’s response Mr. Fournier appealed and SPR 21/0017 was opened as result. Based upon a conversation between a member of the Public Records Division and an Office representative, it is my understanding that the Office intends on providing a subsequent response to Mr. Fournier. Accordingly, the Office is ordered to provide Mr. Fournier with said response to his request, provided in a manner consistent with the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
