Provost Town of Westhampton Office of the Town Clerk One South Road Westhampton, MA 01027 Dear Ms. Provost: I have received the petition of Paul Hardiman appealing the nonresponse of the Town of Westhampton Office of the Town Clerk (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, on December 7, 2020, Mr. Hardiman requested “all items recorded in the public record of the Awarding Authority (Town of Westhampton Selectboard), and a copy of those records, which are deemed to be proprietary for the new public safety complex.” Claiming to not yet have received the responsive records, Mr. Hardiman petitioned this office and this appeal, SPR21/0024, was opened as a result. It is my understanding the requestor notified this Office on January 8, 2021 that the Town was able to assist with the request. In light of the following correspondence, I will consider this administrative appeal closed. If issues remain unresolved, Mr. Hardiman may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
