The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records January 22, 2021 SPR21/0039 Susan M. Galvin Town Clerk Town of Milton 525 Canton Avenue Milton, MA 02186 Dear Ms. Galvin: I have received the petition of Cindy L. Christiansen appealing the response of the Town of Milton (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Christiansen requested the following: 1. A non-manipulated version of the 2/11/18 email included in Mr. Freytag’s response. 2. The ‘dispersion graphics’ file that was on the Town’s website on 08/24/2020, not a manipulated version of that file that appears there now. Subsequently, Ms. Christiansen requested in part, “… unmanipulated email between Ms. Christiansen and Mr. Douglas dated February 11, 2018 [and] included all records and notes.” Prior Appeal The requested records were the subject of a prior determination. See SPR20/2192 Determination of the Supervisor of Records (November 24, 2020). In my November 24, 2020 determination, I learned that the Town planned to provide a supplemental response and as result considered the administrative appeal closed. Unsatisfied with the response, Ms. Christiansen appealed and SPR21/0039 was opened as result. Based upon a conversation between a Public Records Division staff member and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Ms. Christiansen. Accordingly, the Town is ordered to provide Ms. Christiansen with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
