The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records January 25, 2021 SPR21/0062 Shawn A. Williams, Esq. Director of Public Records Records Access Officer City of Boston 1 City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Nathaniel Story of Muckrock News appealing the nonresponse of the City of Boston Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 6, 2020, Mr. Story requested “records stored by the Department in the Axon evidence management solution, Evidence.com,…pertaining to seven (7) reports: evidence created, evidence deleted, category summary, uncategorized evidence, user summary, Axon video summary, sharing audit report, from January 1, 2018 to the present.” Claiming to not yet have received the responsive records, Mr. Story petitioned this office and this appeal, SPR21/0062, was opened as a result. Despite being notified of the opening of this appeal, the Department has yet to provide a response with respect to Mr. Story’s December 6th request. Accordingly, the Department is ordered to provide Mr. Story with said response in accordance with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Story may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Mr. Nathaniel Story Sgt.
