Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received the petitions of Wayne Napolitano appealing the nonresponse of the Department of State Police (Department) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. Napolitano requested records pertaining to specific incident and arrest reports. Claiming to not yet have received a response, Mr. Napolitano petitioned this office and these appeals were opened as a result. Subsequently, I learned that the Department responded to Mr. Napolitano’s requests with responses sent on January 13, 2021. Whereas these appeals were opened as a result of the Department’s lack of a written response, I will now consider these administrative appeals closed. Mr. Napolitano may appeal the substantive nature of the Department’s responses within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
