Murray Supervisor of Records February 2, 2021 SPR21/0115 Ms. Claudia Buruca Records Access Officer Appeals Unit/Public Records Unit Office of Suffolk County District Attorney One Bulfinch Place Boston, MA 02114 Dear Ms. Buruca: I have received the petition of Wayne Napolitano appealing the nonresponse of the Suffolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 29, 2020, Mr. Napolitano requested records concerning the investigation of a named individual that took place in the Orient Heights section of East Boston on December 8, 1992. Claiming to not yet have received the responsive records, Mr. Napolitano petitioned this office and this appeal, SPR21/0115, was opened as a result. A representative of the Office informed the Public Records Division it will investigate whether the Office has any records related to Mr. Napolitano’s request. Accordingly, the Office is ordered to provide Mr. Napolitano with a response to his request in accordance with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Napolitano may appeal the substantive nature of the Office’s response within ninety (90) days.
