Earl Dessert Town of Sturbridge Police Department Public Safety Complex 346 Main Street Sturbridge, MA 01566 Dear Lt. Dessert: I have received the petition of Mr. Patrick Mason appealing the nonresponse of the Town of Sturbridge Police Department (Department) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Mason submitted a request for records related to a certain “motor vehicle accident that took place on December 26, 2020.” Claiming to not yet have received a response, Mr. Mason petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Department intends on providing a written response to Mr. Mason to his respective request. Accordingly, the Department is ordered to provide Mr. Mason with a response made in accordance with the Public Records Law, its Access Regulations and this order within 10 business days. It is preferable to send an electronic copy of the response to this to this office at pre@sec.state.ma.us. Mr. Mason may appeal the substantive nature of the Department’s response within ninety days.
