Assistant General Counsel Boston Public Health Commission 1010 Massachusetts Avenue Boston, MA 02118 Dear Attorney Raza: I have received the petition of Ricardo Fuentes appealing the response of the Boston Public Health Commission (Commission) to their request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 14, 2020, Mr. Fuentes requested the following records: “…all Computer Aided Dispatch Transcripts (CADs), all incident reports, Calls For Service Reports, all incident reports, all reports, all documents, all audio files for 911 calls, all digital files, all log book entries, all 911 documents pertaining to [a specific address] from Nov. 1, 2020 to present .” The Commission provided a response on January 15, 2021. Unsatisfied with the Commission’s response, Mr. Fuentes petitioned this office, and SPR21/0119 was opened as a result. Subsequent to the intervention by a staff person of the Public Records Division, I learned that the Commission responded to Mr. Fuentes’ request with a subsequent response sent on January 29, 2021. Whereas the basis of this appeal was opened as a result of the Commission’s January 15th response, I will now consider this administrative appeal closed. Mr. Fuentes may appeal the substantive nature of the Commission’s response within ninety days. See 950 C.M.R. 32.08(1).
