Silvia, Director Communications & Administrative Resolution Massachusetts Department of Correction 50 Maple Street Milford, MA 01757 Dear Ms. Silvia: I have received the petition of Benjamin Silva appealing the nonresponse of the Department of Correction - MCI Shirley (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 31, 2020, Mr. Silva requested the following records within the possession of the Department: • “The most recent contract between MCI Shirley and any vendor for the provision of entertainment videos to be shown to the inmate population; • All documents describing the specific entertainment videos provided under contract to MCI Shirley between January 1, 2020 and December 31, 2020 (inclusive).” Claiming to not yet have received the responsive records, Mr. Silva petitioned this office and this appeal, SPR21/0175, was opened as a result. Subsequently, I learned that the Department responded to Mr. Silva’s request with a response sent on February 9, 2021. Whereas the basis of this appeal was opened as a result of the Department’s lack of written response, I will consider this administrative appeal closed. Mr. Silva may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
