Murray Supervisor of Records February 11, 2021 SPR21/0193 Gregory Lucey City Clerk City of Malden, 215 Pleasant Street Malden, MA 02148 Dear Mr. Lucey: I have received the petition of John Saia appealing the nonresponse of the City of Malden (City) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 23, 2020, Mr. Saia requested the following records: “1. Records of any GMax tests conducted (and their results) for any athletic fields in the City between 2010 and present day. 2. …artificial turf maintenance manual identified in the APT Sample Turf Warranty uploaded file ... 3. records … received by Malden’s Conservation Commission of any pre-development and post-development information regarding compensatory flood storage and peak discharge rates of water that might pertain to the Roosevelt Park improvement Project.” Claiming to not have yet received a response, Mr. Saia petitioned this office and SPR21/0193 was opened as a result. Subsequently, I learned that the City intends on providing a written response to Mr. Saia’s request. Accordingly, the City is ordered to provide Mr. Saia with a response in a manner consistent with the Public Records Law, its Access Regulations and this order within 10 business days. It is preferable to send an electronic copy of the response to this to this office at pre@sec.state.ma.us. Mr. Saia may appeal the substantive nature of the City’s response within ninety days.
