Murray Supervisor of Records February 12, 2021 SPR21/0198 Gregory Lucey City Clerk City of Malden 215 Pleasant Street Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Brian DeLacey appealing the nonresponse of the City of Malden Office of the Mayor (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 14, 2020, Mr. DeLacey requested, “… email sent or received by any member of the Mayor's Office – including with members of the public, any council, committee, board, or commission in the city, or others who may be elected, appointed or employed by the state, including those known as the state delegation and their staff colleagues; where such records match the following Records Criteria [including] … the following words or numbers: earmark, park, playground, Devir, appropriation, budget, open space, $250,000 from 12/1/20 to the date a response is provided.” Claiming to not yet have received the responsive records, Mr. DeLacey petitioned this office and this appeal, SPR21/0198, was opened as a result. Despite being notified of the opening of this appeal, the City has yet to provide a response with respect to Mr. DeLacey’s December 14th request. Accordingly, the City is ordered to provide Mr. DeLacey with said response consistent with the Public Records Laws and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DeLacey may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
