Brown Town of Florida Town Clerk 379 Mohawk Trail Drury, MA 01343 Dear Ms. Brown: I have received the petition of Todd Wallack of the Boston Globe appealing the nonresponse of the Town of Florida Office of the Town Clerk (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 29, 2020, Mr. Wallack requested, “an electronic copy of the municipality’s public list of registered voters, also known as the voter file.” Claiming to not yet have received the responsive records, Mr. Wallack petitioned this office and this appeal, SPR21/0211, was opened as a result. It is my understanding that to date, no response has been provided. Accordingly, the Town is ordered to provide Mr. Wallack with a response to the request provided in a manner consistent with this order, the Public Records Laws and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Wallack may appeal the substantive nature of the Town’s response within ninety (90) days.
