Summer Town of Heath Office of the Town Clerk One East Main Street Heath, MA 01346 Dear Ms. Summer: I have received the petition of Todd Wallack of the Boston Globe appealing the nonresponse of the Town of Heath Office of the Town Clerk (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 29, 2020, Mr. Wallack requested, “an electronic copy of the municipality’s public list of registered voters, also known as the voter file.” Claiming to not yet have received the responsive records, Mr. Wallack petitioned this office and this appeal, SPR21/0213, was opened as a result. Subsequently, I learned that the Town responded to Mr. Wallack’s request with a response sent on February 12, 2021. Given that the basis of this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed. Mr. Wallack may appeal the substantive nature of the Town’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
