Aliberti Easthampton Police Department 32 Payson Avenue Easthampton, MA 01027 Dear Chief Aliberti: I have received the petition of Gaby Stevenson appealing the response of the Easthampton Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 20, 2020, Ms. Stevenson requested the following records:  “Records of all school arrests from the past 5 years (middle school and high school) [including] any situation that included an interaction between a police officer and a student on the school premise--regardless if that interaction led to arrest.  A complete breakdown of the police budget and spending [including] any additional earnings police officers make on top of their base salary.  Internal Affairs Record for all complaints against police officers from Easthampton from the past 5 years regardless of the results of these complaints.” Prior determination The requested records were the subject of a prior determination. See SPR21/0060 Determination of the Supervisor of Records (January 15, 2021). Unsatisfied with the response, Ms. Stevenson appealed and SPR21/0227 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Ms. Stevenson. Accordingly, the Department is ordered to provide Ms. Stevenson with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Stevenson may appeal the substantive nature of the Department's response within ninety days.
