Murray Supervisor of Records February 16, 2021 SPR21/0232 Ms. Jeanmarie Tarara Town of Holbrook 50 North Franklin Street Holbrook, MA 02343 Dear Ms. Tarara: I have received the petition of Joe DiFazio of The Patriot Ledger appealing the nonresponse of the Town of Holbrook (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. DiFazio requested various documents including contracts, agreements, invoices, and receipts between the Town and an identified individual and LLC. Mr. DiFazio also submitted the same records request to the Holbrook Police Department, for which the Department provided a full response. Having received no response from the Town, Mr. DiFazio petitioned our office. Subsequent to the intervention of a member of the Public Records Division, I learned that the Town intends to provide a supplemental response clarifying whether they are in possession of any records in addition to those provided by the Holbrook Police Department. Accordingly, the Town is ordered to provide Mr. DiFazio with said response within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DiFazio may appeal the substantive nature of the Town’s response within 90 days.
