Murray Supervisor of Records February 4, 2021 SPR21/0237 Helen Rush-Lloyd Records Access Officer Department of Public Health 250 Washington Street Boston, MA 02108 Dear Ms. Rush-Lloyd: I have received the petition of Ms. Clodagh Lane appealing the nonresponse of the Department of Public Health (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 23, 2020, Ms. Lane requested certain records related to “COVID-19 Order No. 43” & “COVID-19 Order No. 58.” Claiming to not yet have received a response, Ms. Lane petitioned this office and this appeal was opened as a result. Subsequently, I learned that the Department provided a response with respect to Ms. Lane’s request on February 4, 2021. Where this appeal was opened as a result of the lack of response by the Department, I will consider this administrative appeal closed. Ms. Lane may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
