Staples, Esq. General Counsel Massachusetts Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received the petition of Attorney Elizabeth T. Mone of Mone Law appealing the nonresponse of the Department of State Police (Department) to her request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 28, 2020, Attorney Mone requested the following records for a named Trooper: “1. Detailed timesheets, including overtime pay, for February 2013; and 2. The public portions of the officer’s internal affairs records.” Claiming to not yet have received a response, Attorney Mone petitioned this office and SPR21/0252 was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Attorney Mone with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Mone may appeal the substantive nature of the Department’s response within ninety days.
