G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 24, 2020, and December 30, 2020, Mr. Wood made three separate requests to the City. Specifically, he requested: December 24, 2020 request – City’s request no. 2020-1808 (Appeal SPR21/0270) “[A]ll emails sent or received between 12/1/2020 and 12/24/2020 by Mayor Spicer and four other individuals which contain any of the following terms, . . . ‘The Source,’ or ‘Framingham Source,’ which do not contain in any address, to, from, CC, or BCC field any of the following addresses . . .” December 24, 2020 request – City’s request no. 2020-1810 (Appeal SPR21/0272) All emails sent or received by Mayor Spicer and three other individuals that contain the words “Framingham Unfiltered,” “Framingham Forward,” “Frank Wood,” and “Mr. Wood” between 9/1/2020 and 12/27/2020. December 30, 2020 request – City’s request no. 2020-1837 (Appeal SPR21/0274) An identified person’s resignation letter; any email’s sent by the identified person on December 29, 2020; any emails which contain the identified person in any address fields (to, from, cc, bcc) between 12/24/2020 and 12/29/2020 (including any attachments). Jennique Horrigan SPR21/0270; SPR21/0272 and SPR21/0274 Page 2 February 17, 2021 The City’s January 11th, 13th and 27th responses In the City’s January 2021 responses, it indicated that an extension of time is necessary in order to provide the responsive records. As a result, Mr. Wood petitioned the Supervisor of Records (Supervisor), and appeals SPR21/0270; SPR21/0272 and SPR21/0274 were opened. These appeals have been combined in this determination due to the similarity of the City’s responses as to an extension of time to provide the records, and Mr. Wood’s objection to the extension of time. The City informed a Senior Attorney in the Public Records Division that it intends to provide a supplemental response and the responsive records. Conclusion Accordingly, the City is ordered to provide Mr. Wood with said response to the requests, in a manner consistent with this order, the Public Records Law and its Regulations within ten business days. A copy of any such response(s) must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
