Records Access Officer Middlesex County Sheriff’s Office 400 Mystic Avenue Fourth Floor Medford, MA 02155 Dear Attorney Patel: I have received the petition of Abigail Husselbee appealing the nonresponse of the Middlesex County Sheriff’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 2, 2020, Ms. Husselbee requested the following records within the possession of the Office:  “ … copies of any reports and written communications filed on behalf of the Middlesex Sheriff with the Massachusetts House and Senate Ways and Means Committees, the Massachusetts Executive Office of Public Safety and Security, and the Massachusetts executive office for administration and finance in 2019 and 2020. … including, but … not limited to specific data provided to allow for the reporting of recividism rates for all pre-trial, county sentenced and state sentenced inmates, total costs per inmate by facility and by department, and other information required to be provided to any of these entities pursuant to section 8910-7110 of chapter 154 of the Acts of 2019;  …copies of any letters, reports or documents submitted by the Middlesex Sheriff to any member of the Massachusetts Senate or House of Representatives in 2019 and 2020 related to the cost of telephone phone calls charged to people held or incarcerated at any facility in Massachusetts as well as related to any legislation that pertains or pertained to the cost of telephone phone calls charged to people who are incarcerated or detained in a jail in Massachusetts.” Claiming to not yet have received the responsive records, Ms. Husselbee petitioned this office and this appeal, SPR21/0273, was opened as a result. Attorney Malav Patel SPR21/0273 Page 2 February 12, 2021 Subsequently, I learned that the Office responded to Ms. Husselbee’s request with a response sent on February 4th and a further response was issued on February 11th. Given that the basis of this appeal was opened as a result of the Office’s lack of a written response, I will now consider this administrative appeal closed.
