Murray Supervisor of Records February 17, 2021 SPR21/0291 Captain Steven Giannini Support Services Commander Fitchburg Police Department 20 Elm Street Fitchburg, MA 01420 Dear Captain Giannini: I have received the petition of Michael O’Farrell appealing the response of the Fitchburg Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 15, 2020, Mr. O’Farrell requested the records detailing, “… the extensive property damage along the 153' property line [of a named address] including cutting and uprooting of several trees, bushes and shrubs and … [identity of the neighboring property caretaker].” Previous appeal This request was the subject of a previous appeal. See SPR20/2005 Determination of the Supervisor of Records (November 2, 2020). Unsatisfied with the Department’s response, Mr. O’Farrell appealed and SPR21/0291 was opened as a result. Subsequently, I learned that the Department responded to Mr. O’Farrell’s request with a supplemental response sent on February 11, 2021. Given that the basis of this appeal was opened as a result of the Department’s January 11th response, I will now consider this administrative appeal closed. Mr. O’Farrell may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
