Murray Supervisor of Records February 19, 2021 SPR21/0300 Maeve Moran Principal Clerk City of Marlborough Police Department 355 Bolton Street Marlborough, MA 01752 Dear Ms. Moran: I have received the petition of Patrick Mason of The Mason Group, appealing the response of the City of Marlborough Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 2, 2021, Mr. Mason requested “reports of the following 10-24-2011 Drug Investigation; 2-21-2014 Disturbance; 9-4- 2014 Threats and 5-1-2015 Assist other agency.” The Department provided Mr. Mason with the reports of the 10-24-2011 Drug Investigation and 2-21-2014 Disturbance. The Department withheld under Exemption (c), in their entirety, the 9-4-2014 report pertaining to threats and the 5-1-2015 report pertaining to the Department’s assistance to another agency. As a result of the Department’s withholding of those two reports, Mr. Mason petitioned the Supervisor of Records (Supervisor), and this appeal was opened. Subsequently, the Department indicated to an attorney in the Public Records Division that it will provide a further response to the requestor. Conclusion Accordingly, the Department is ordered to provide Mr. Mason with said response to the request, in a manner consistent with this order, the Public Records Law and its Regulations within 10 business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mason may appeal the substantive nature of the response within 90 calendar days. See 950 C.M.R. 32.08(1).
