Mitchell, Jr. Fire Chief Town of Georgetown Fire Department 47 Central Street Georgetown, MA 01833 Dear Chief Mitchell: I have received the petition of Nicholas Rio appealing the response of the Georgetown Fire Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 29, 2021, Mr. Rio requested “the harassment claim, emails, and any other pertinent documents be provided to me for review by my counsel…” The Department responded on February 4, 2021, denying the requested records “[a]s the investigation is ongoing…” Unsatisfied with the Department’s response, Mr. Rio petitioned this office, and SPR21/0302 was opened as a result. Subsequent to the opening of this appeal, the Department provided a supplemental response through its Town counsel on February 8, 2021. Whereas the basis of this appeal was opened as a result of the Department’s February 4th response, I will now consider this administrative appeal closed.
