Murray Supervisor of Records February 16, 2021 SPR21/0351 Mr. Michael McCarthy Records Access Officer, Vice President of Administration Northern Essex Community College 100 Elliott Street Haverhill, MA 01830 Dear Mr. McCarthy: I have received the petition of Bret Seferian appealing the nonresponse of Northern Essex Community College (College) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 22, 2020, Mr. Seferian requested in part, “information on behalf of Massachusetts Community College Council (MCCC) about funding from the Federal CARES Act on November 12, 2020 to the [named] lead negotiator for Board of Higher Education (BHE) …” Claiming to not yet have received a response, Mr. Seferian petitioned this office and SPR21/0351 was opened as a result. Subsequently, I learned that the College responded to Mr. Seferian’s request with a response sent on February 12, 2021. Given that the basis of this appeal was opened as a result of the College’s lack of a written response, I will now consider this administrative appeal closed. Mr. Seferian may appeal the substantive nature of the College’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
