The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records February 22, 2021 SPR21/0361 Patrick Stone Records Access Officer Cape Cod Community College 2240 Iyannough Road West Barnstable, MA 02668-1599 Dear Mr. Stone: I have received the petition of Bret Seferian of the Massachusetts Teachers Association appealing the nonresponse of the Cape Cod Community College (College) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 22, 2021, Mr. Seferian requested, “... information regarding the use of funds from the federal CARES Act at Cape Cod Community College [including] 1. The amount of funding the college received for direct distribution to students. 2. The amount of that funding the college has directly distributed to students. 3. The amount of funding the college received not for direct distribution to students. 4. The amount of that funding the college as expended. i. The ten highest expenditures of that funding 5. The criteria used for expending that funding.” Claiming to not yet have received a response, Mr. Seferian petitioned this office and SPR21/0361 was opened as a result. Subsequently, I learned that the College responded to Mr. Seferian’s request with a response sent on February 17, 2021. Whereas the basis of this appeal was opened as a result of the College’s lack of a written response, I will now consider this administrative appeal closed. Mr. Seferian may appeal the substantive nature of the College’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
