Assistant City Solicitor City of Lowell Law Department 375 Merrimack Street City Hall, Third Floor Lowell, MA 01852 Dear Attorney Hucksam: I have received the petition of Jim Haddadin, of NBC10 Boston, appealing the nonresponse of the City of Lowell Law Department (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 21, 2021, Mr. Haddadin sought, “…two (2) categories of records within the possession of the City [:] a. Any written notices issued to Lowell Police Department employees since January 6, 2021 that pertain to the initiation of internal affairs proceedings; b. All citizen complaints received since January 6, 2021.” Claiming to not yet have received the responsive records, Mr. Haddadin petitioned this office and this appeal, SPR21/0385, was opened as a result. Subsequently, I learned the City responded to Mr. Haddadin with a response dated February 17, 2021. Given that the basis of this appeal was opened as a result of the City’s lack of a written response provided, I will now consider this administrative appeal closed. Mr. Haddadin may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
