Murray Supervisor of Records March 2, 2021 SPR21/0390 Michael Boswell Records Resource Officer New Bedford Police Department 871 Rockdale Avenue New Bedford, MA 02740 Dear Mr. Boswell: I have received the petition of Frank DePasquale Esq. of Murphy & Riley P.C. appealing the response of the New Bedford Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 19, 2020, Mr. DePasquale requested, “a copy of the police accident report, any incident and accident reports, towing records, statements from any victims, participants and witnesses, and a copy of the recorded 911 call regarding an accident involving [named persons] … on September 15, 2019 at approximately 15:45 a.m. at or near [identified address] … New Bedford, MA.” The Department responded on November 23, 2020 denying a request to produce records. Unsatisfied with the Department’s response, Attorney DePasquale petitioned this office, and SPR21/0390 was opened as a result. Subsequently I learned that the Department provided a supplemental response to Attorney DePasquale on February 25, 2021. Whereas the basis of this appeal was opened as a result of the Department’s November 23rd response, I will now consider this administrative appeal closed. Attorney DePasquale may appeal the substantive nature of the Department’s February 25th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
