Murray Supervisor of Records February 26, 2021 SPR21/0406; SPR21/0407 Angie Ellison City Administrator City of North Adams 10 Main Street North Adams, MA 01247 Dear Ms. Ellison: I have received the petitions of Derek Rougeau appealing the nonresponse of the City of North Adams (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 15, 2020, and January 23, 2021, Mr. Rougeau requested: “[1] Record of when [a certain individual] was issued a remote key fob for the gates at Harriman West Airport, and who issued it. [2] Record of activity of [a certain individual’s] remote key fob. [3] The name and contact information of the company that oversees and services the magnetic security gates at the Harriman West Airport [and] [4] [T]he contact information for the company or companies that oversees the maintenance and software of the North Adams Airport security gates to include, names, emails, and phone numbers.” Claiming to have received no response, Mr. Rougeau petitioned this office and these appeals, SPR21/0406 and SPR21/0407, were opened as a result. Subsequently, the City emailed this office on February 25, 2021, indicating that it had provided responsive records to Mr. Rougeau. Whereas this matter was opened based upon the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Rougeau may appeal the substantive nature of the City’s response, within ninety days. See 950 C.M.R. 32.08(1).
