Massachusetts Bay Transportation Authority 10 Park Plaza, Suite 7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Friedrich Lu appealing the nonresponse of the Massachusetts Bay Transportation Authority (MBTA) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 20, 2021, Mr. Lu requested the following records: “(1) name of the operator of the bus route 10 (City Point to Copley Square' number unknown) which was supposed to be at the bus stop of Southampton Street and Atkinson Street, Boston, on Friday, Jan 15, 2021 at 6:45 am … (2) [For] Saturday, Jan 16, 2021 at the bus stop Common Street at Woburn Common bus number 2079, name [of bus driver][,] date and time of the bus ride [and] … a copy of the tape for the ride.” Having received no response, Mr. Lu petitioned this office and SPR21/0426 was opened as a result. Subsequently, I learned that a representative from the MBTA intends to provide a written response to Mr. Lu. Accordingly, the MBTA is ordered to provide Mr. Lu with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Lu may appeal the substantive nature of the Office’s response within ninety days.
