G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 14, 2021, Mr. Rocheleau requested the following: MassPort payroll data for calendar years 2019-2020 that is in spreadsheet form and is broken down by year and has a separate column for each of the following pieces of information: o the calendar year; o each worker's full name; o their unique employee ID number (or, if preferred, some other random unique identifier); o their position/title; o whether they are full or part-time, etc. o the total amount of pay they received in that position; o the total amount of base/regular pay they received in that position; o the total amount of buyout pay they received in that position; o the total amount of overtime pay they received in that position; o the total amount of any other type of pay they received in that position. Claiming not to have received a substantive response, Mr. Rocheleau petitioned this office. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that MassPort intends to provide a written response to Mr. Rocheleau. Accordingly, MassPort is ordered to provide Mr. Rocheleau with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of MassPort’s response within ninety days.
