Murray Supervisor of Records March 9, 2021 SPR21/0469 Ms. Tracey Blais Town Administrator Town of Newbury 25 High Street Newbury, MA 01951-4799 Dear Ms. Blais: I have received the petition of Jack Rybicki appealing the response of the Town of Newbury (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 23, 2020; January 7, 2021 and January 11, 2021, Mr. Rybicki requested: “several categories of records pertaining to the Town’s Transfer Station and G. Mello, including correspondence; contracts; cash/gross revenue generated; a tally of YOY tons of household trash removed, including metals and glass; stickers issued; public solicitation by public bid process; and correspondence between Town Counsel and Town leaders pertaining to overview, review, guidance or contractual concerns.” Prior appeal The $175.00 fee estimate from the Town was the subject of a prior appeal. See SPR21/0195 Determination of the Supervisor of Records (Supervisor) (February 11, 2021). In my February 11, 2021 determination, I ordered the Town to provide a response to clarify whether the Town is charging fees for segregation and redaction that are not required by law. See G. L. c. 66, § 10(d)(iii); see also 950 CMR 32.06(4). This office was notified that the Town provided s subsequent response to Mr. Rybicki on March 8, 2021. Conclusion Where the Town provided a subsequent response to Mr. Rybicki, I will consider this administrative appeal closed. Mr. Rybicki may appeal the substantive nature of the Town’s response within 90 calendar days. See 950 C.M.R. 32.08(1).
