Assistant City Solicitor City of Worcester Law Department 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Attorney Joseph Hennessey appealing the nonresponse of the City of Worcester (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In a letter dated January 30, 2021, Attorney Hennessey requested various records concerning the Worcester Police Department’s contact with certain individuals, and entry into a particular address. Having received no response, Attorney Hennessey appealed to this office. Following the intervention by a staff attorney of the Public Records Division, I learned that the City did not receive the original request until being notified of an appeal by this office on February 24, 2021. Additionally, I learned that a representative from the City intends to provide a written response to Attorney Hennessey. Accordingly, the City is ordered to provide Attorney Hennessey with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Hennessey may appeal the substantive nature of the City’s response within ninety days.
